
2.4.2 Vacation
Intent
[Company Name] understands the importance of work-life balance and personal time for employees. Employees are encouraged to use their accrued paid vacation time for rest, relaxation, and personal pursuits. As such, the purpose of this policy is to explain the standards, guidelines, and procedures for paid vacation time for all employees.
Guidelines
All employees are encouraged to use their allotted vacation time in full, every year. The following policy statements are intended to guide paid vacation procedures for employees.
For vacation purposes, the vacation entitlement year spans the [Company Name]’s fiscal year, running from [Date] to [Date]. Employees are entitled to a pro-rated amount of vacation time for the period between the date of hire and the beginning of the vacation entitlement year (otherwise known as a stub period).
Employees are entitled to vacation every vacation entitlement year in accordance with the following schedule:

Paid vacation time granted to an employee must be used in its totality within [Number] months after the end of the vacation entitlement year in which it was earned.
Employees must submit a written vacation request for the period of [Date] to [Date] by [Date]. Requests from [Date] to [Date] must be submitted by [Date] each year. Any submissions following these dates will qualify for remaining time only. Vacation may only be taken once approval is received from their supervisor/director (as applicable).
Any conflicts among employee vacation requests will be decided based on employee seniority, [Company Name]’s needs, and the judgement of the supervisor/director.
Unless it qualifies as a protected leave, a day off without pay will be at the discretion of the supervisor/director and is not suggested on a regular basis. Anything over 5 consecutive days is considered a leave of absence and must be requested in writing.
Unless it qualifies as a protected leave, all paid vacation entitlements must be used prior to the approval of any unpaid time off.
If a mutually acceptable time for vacation cannot be found, [Company Name] reserves the right to schedule vacations for employees as a method of ensuring that banked vacation time is used before year-end. The employee will receive at least two weeks’ written notice of the start date of their vacation.
Vacation scheduling is the responsibility of the site supervisors or the director as applicable, who will ensure that all employees are given their full vacation entitlement, while considering the efficiency of the site.
Vacation time may be divided into more than one-week periods if desired by the employee, provided that their supervisor/director can effectively allocate tasks to remaining employees. In this case, the employee must complete a written request to be kept on file.
Employees who are away for part or all of a year due to a layoff or job protected leave as defined in the Employment Standards Act (ESA) are entitled to vacation time as per their years of service, upon their return to work. Employee’s vacation pay will be pro-rated to reflect the vacation pay not accrued while on leave.
Leaves of absence for non-ESA regulated leaves (i.e., medical leaves, personal leaves to attend school, training, or other employment) do not count towards continuous service or seniority. Employees who are on a leave of absence for non-regulated reasons will have their vacation time and pay pro-rated to reflect the time not working.
If an employee's services are terminated, vacation pay earned up to the date of termination will be paid to the employee no later than seven days after employment ends or on the day that would have been the employee’s next pay day, whichever is later.
If a public holiday occurs during an employee's vacation period, the employee will be granted one additional day of vacation. Brief illnesses that occur during a vacation period may not be counted towards sick leave.
